1. Scope and Definitions

1.1 These General Terms and Conditions (“Terms”) apply to all purchases made through the online store of Auge Atelier (“Seller”).

1.2 A consumer is any natural person acting for purposes outside their trade, business, craft, or profession pursuant to Article 3 of the Italian Consumer Code (D.Lgs. 206/2005).

1.3 An entrepreneur is any natural or legal person acting in the exercise of their business or professional activity.

1.4 These Terms apply exclusively. Deviating terms of the customer shall not be recognized unless expressly agreed in writing.


2. Conclusion of Contract

2.1 By placing products in the shopping cart and clicking “Order Now,” the customer submits a binding offer to purchase the selected goods.

2.2 An automatic confirmation email acknowledges receipt of the order but does not constitute acceptance.

2.3 The contract is concluded only upon dispatch confirmation or shipment of the goods.

2.4 The contract language is English or Italian.


3. Delivery and Availability

3.1 Delivery times are estimates and begin after order confirmation and payment receipt.

3.2 If a product is unavailable, the Seller will notify the customer without undue delay. If permanently unavailable, no contract is concluded.


4. Retention of Title

4.1 Goods remain the property of AUGE Atelier until full payment has been received.


5. Prices and Shipping Costs

5.1 All prices include applicable VAT in accordance with Italian tax law.

5.2 Shipping costs are displayed during checkout and must be borne by the customer unless otherwise stated.

5.3 In the event of withdrawal, the customer bears the direct return shipping costs unless the goods are defective or incorrectly delivered.


6. Payment Methods

6.1 Accepted payment methods are displayed at checkout and may include Credit Card, PayPal, Klarna, and other available options.

6.2 The Seller reserves the right to limit certain payment methods.


7. Legal Warranty

7.1 Consumers are entitled to the legal guarantee of conformity pursuant to Articles 128–135 of the Italian Consumer Code.

7.2 The Seller is liable for lack of conformity existing at delivery and manifesting within 24 months.

7.3 Consumers must notify defects within 2 months of discovery.

7.4 Entrepreneurs must report defects in writing within 14 days of delivery.


8. Right of Withdrawal

8.1 Consumers have the right to withdraw from the contract within 14 days without giving any reason.

8.2 The withdrawal period expires 14 days after the customer (or a third party other than the carrier) takes possession of the goods.

8.3 To exercise the right of withdrawal, the customer must send a clear statement to augeatelier@gmail.com


8.4 Exclusions from Withdrawal

The right of withdrawal does not apply to:

  • Goods made to the customer’s specifications or clearly personalized

  • Sealed goods not suitable for return for health or hygiene reasons if unsealed after delivery

Earrings cannot be returned if the hygiene seal has been broken.


9. Consequences of Withdrawal

9.1 If the customer withdraws, payments received (including standard delivery costs) will be refunded within 14 days after receiving the returned goods.

9.2 Refunds will be made using the original payment method.

9.3 The Seller may withhold reimbursement until the goods are received.

9.4 The customer must return goods within 14 days of notifying withdrawal.

9.5 The customer bears return shipping costs.

9.6 The customer is liable for any diminished value resulting from handling beyond what is necessary to examine the goods.

9.7 Vintage items with security tags may only be returned if the tag remains attached and the item shows no signs of use.


10. Lost, Stolen or Undeliverable Shipments

10.1 The Seller is not responsible for packages marked as delivered by the carrier.

10.2 The Seller is not responsible for loss due to incorrect address entry.

10.3 Unclaimed parcels returned to the Seller may incur a processing fee deducted from the refund.

10.4 Once shipped, delivery addresses cannot be modified.

10.5 The Seller is not liable for return shipments lost or arriving empty.


11. Data Protection

11.1 Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Italian data protection laws.

11.2 Further details are provided in the Privacy Policy.


12. Online Dispute Resolution

12.1 The EU Online Dispute Resolution platform is available at:
https://ec.europa.eu/consumers/odr/

12.2 The Seller is not obliged to participate in dispute resolution proceedings before a consumer arbitration board.


13. Applicable Law and Jurisdiction

13.1 These Terms are governed by Italian law.

13.2 For consumers, jurisdiction lies with the court of the consumer’s place of residence or domicile in Italy.

13.3 For entrepreneurs, jurisdiction lies with the court of the Seller’s registered office.

13.4 If any provision is deemed invalid, the remaining provisions remain unaffected.
